These are Travel Terms and Conditions, also refer to Website Terms & Conditions

Agreement
  1. Your agreement is with GO Schoolies Pty Ltd whose details are Unit 152, 248 Osborne Avenue Clayton South, Victoria 3169.
  2. By agreeing with these Travel Terms and Conditions you confirm that you have read and fully understand the following Travel Terms and Conditions and agree to abide by and be bound by the Travel Terms and Conditions.
  3. In addition to the signing of this agreement the Applicants use of any tickets and documents shall constitute your acceptance, as well as your parental/guardian’s acceptance if you are a minor, and your agreement and consent to the Travel Terms and Conditions of this agreement.
Traveller Information Profile
  1. The Traveller Information Profile (link to be provided with your welcome letter) must be fully completed and returned to GO Schoolies by 31 July in the year of the tour.
  2. If the traveller signs up for GO Schoolies after 31 July, the Traveller Information Profile must be fully completed and submitted to GO Schoolies prior to receiving confirmation of the tour.
Price
  1. The price for the tour does not include the following which are the responsibility of the traveller to arrange and pay for:
    1. The traveller’s passport, visas and any departure or entry taxes unless stated otherwise on the particular tour itinerary inclusions.
    2. The traveller’s prescribed or other medication.
    3. The travellers clothing and personal items suitable for the location and activities of the tour.
    4. Spending money.
    5. GO Schoolies endeavours to maintain its advertised price but reserves the right to increase this price without notice at any time up to and including the day of departure of any tour in the event of exchange rate fluctuations, increases in fuel costs, airport charges, airfares or increases in ground operator services fees.
    6. Each traveller is responsible for emergency evacuation expenses.
    7. Additional travel insurance coverage for cancel for any reason etc, is up to the traveller to obtain if they wish.
  2. Payment of the price shall be as follows:
    1. An initial non-refundable deposit of $295.00.
    2. Payment options are available quarterly, monthly or fortnightly, as per your nominated selection and as outlined on your invoice.
    3. Go Schoolies will automatically deduct your instalment payments on their due dates directly from your Visa or Mastercard debit or credit card.
    4. In the event that insufficient funds are available for your instalment, a processing fee of $50.00 will be added to your current instalment.
    5. Payment in full, including airline/airport and government taxes, together with any requested additional insurance cover or processing fees must be paid 3 months prior to your travel departure date. This final amount due will be advised 4 months prior to your travel departure date.
    6. Any processing fees are non-refundable in case of your cancellation from the tour and do not form any part of any refunds due.
Cancellation
  1. Should you decide to cancel from the tour then a cancellation fee will apply depending upon the time of your cancellation.
    1. For cancellation more than 12 months prior to the tour final payment due date, the cancellation fee is $500.00.
    2. For cancellation between 12 months and 9 months prior to the tour final payment due date, the cancellation fee is 20% of the tour cost.
    3. For cancellation between 9 months and 3 months prior to the tour final payment due date, the cancellation fee is 40% of the tour cost.
    4. For cancellation between 3 months prior to the final payment due date and 1 month after the final payment due date, the cancellation fee is 60% of the tour cost.
    5. For cancellation 2 months or less from the date of travel, the cancellation fee is 100% of the tour cost.
    6. Should you cancel from the tour, up until final payment time (3 months before departure) you have the option to find a new traveller to take your place, not a previous referral. In this case you will not be charged a cancellation fee.
    7. All cancellations must be advised in writing to GO Schoolies.
    8. Refunds will take 4 to 8 weeks to be processed.

    At any time, any additional cancellation costs imposed by any airlines, hotels or tour companies for the cancellation of tickets or accommodation shall be paid by the traveller and shall in addition be deducted from the remaining balance of the price paid by the traveller.

Travellers' Health
  1. The traveller must ensure that he/she is in good physical, emotional and mental health prior to the tour, noting the destination and the activities that will occur on the tour. The traveller must complete their Traveller Information Profile by the due date, as detailed above. The traveller agrees to advise GO Schoolies if any of the information supplied changes prior to the departure date of the tour.
  2. The traveller has disclosed to GO Schoolies prior to the tour final payment date.
    1. All medical information relating to allergies, existing medical condition(s) or any other like information that should be disclosed to GO Schoolies relevant to the traveller and to the tour must be disclosed in the Traveller Information Profile.
    2. Failure to disclose any of the medical information requested in the Traveller Information Profile to GO Schoolies could result in the traveller being treated as cancelled from the tour at any time either before departure or during the tour.
    3. GO Schoolies shall not be responsible for any medical, dental, hospital, ambulance, pharmaceutical or other treatment expenses incurred by the traveller whilst on the tour and the traveller indemnifies GO Schoolies regarding any such expenses incurred.
Insurance
  1. Comprehensive Travel Insurance is mandatory for all GO Schoolies travellers.
    1. Insurance cover for any existing medical conditions is also mandatory and must be disclosed to the insurer directly from the traveller as directed by GO Schoolies.
    2. GO Schoolies offers a Comprehensive Travel Insurance policy as part of the tour package. The offered insurance provides coverage from 2 months prior to departure.
    3. Should the traveller wish to have coverage in place earlier than 2 months of the policy offered by GO Schoolies, then they must insure with an alternate travel insurer.
    4. Complete details of the Travel Insurance offered by GO Schoolies, including the company and their insurance Terms and Conditions and product disclosure statement together with coverage amounts provided to, will be provided as a link on your welcome letter.
    5. Comprehensive Travel Insurance can be obtained from an insurance provider of your choice. As well as additional insurance coverage or benefits. A copy of your Certificate of Insurance is required by GO Schoolies prior to travel should you decide to obtain insurance from another Travel Insurance provider.
    6. The traveller’s baggage and personal property throughout the tour is at the “owner’s risk”. GO Schoolies shall not be responsible or liable for the loss or damage to any of the traveller’s baggage or personal property.
Tour Itineraries Alterations And Viability
  1. GO Schoolies reserves the right to alter, amend or cancel any of the arrangements contained in the tour itineraries.
  2. If in the opinion of GO Schoolies the tour is no longer viable because of cancellations or where other circumstances that arise are beyond GO Schoolies control, then GO Schoolies shall;
    1. where there are cancellations, treat all of the travellers of that tour as having cancelled his/her participation in that tour; and,
    2. where those travellers wish to and are eligible to participate in another of GO Schoolies tour(s), do its best to arrange another GO Schoolies tour suitable to the traveller.
Variations
  1. In a situation where a traveller is seeking a variation to a tour travel date then the following shall apply;
    1. Travel deviations during the tour itself are not permitted.
    2. The traveller must leave Australia with the tour group that the traveller is touring with. However, a change on the set return date of the tour group may, at the absolute and sole discretion of GO Schoolies, be arranged but only where the following applies;
      1. The traveller requests this change in writing to GO Schoolies no less than 2 months before the tour departure date.
      2. An appropriate booking can be made by GO Schoolies with the airlines within the cost of the tour as all travellers must remain part of the GO Schoolies group booking.
      3. GO Schoolies will not allow, under any circumstances, travellers to make their own airline arrangements.
      4. All changes are subject to airline space availability in the same class as the group booking.
      5. Any additional airline charges to deviate from the group booking will be passed on to the traveller.
      6. A service fee of $250.00 shall be charged to the traveller for this deviation in the tour.
      7. In the event that a traveller needs to return home, either for disciplinary reasons or personal reason, e.g. the death or illness of an immediate family member, the GO Schoolies Squad Leader will be responsible for coordinating the delivery of the minor. However, should this conflict with the GO Schoolies Squad Leader’s duty of the care to the rest of the group, alternative arrangements will need to be made by the parents of the traveller.
      8. The traveller may travel as an unaccompanied minor on the airline provided that the airline provides full unaccompanied minor service. This service must include delivery of the minor by the GO Schoolies Squad Leader to the airline staff and on arrival the airline staff deliver in person the minor to the responsible adult allocated to collect the minor. Fees are applicable for this service.
      9. In all cases, a legal waiver must be signed by both parents, holding GO Schoolies harmless for all private travel both pre and post tour. GO Schoolies has no control over the safety of the traveller whilst they are travelling in a private capacity. GO Schoolies strongly recommends that the school holds a similar waiver.
      10. All deviations must have full travel insurance coverage during the deviation time period.
      11. GO Schoolies will also assess the potential insurance risks associated with the deviation.
      12. The GO Schoolies Squad Leader must agree to any special arrangements made to take legal charge of the traveller for any variation. In the event that the tour leaders feel that their duty of care or legal liability may be compromised, the variation will not be allowed.

    Notwithstanding the above, the Director of GO Schoolies will have the final decision to allow or deny the variation based on the legal risk it poses in relation to the safety of the traveller and GO Schoolies’ duty of care to the traveller.

  2. The traveller acknowledges that GO Schoolies acts only as agents for hotels, airlines, bus companies, railway and ferry companies, or other services, and all coupons, exchange orders, receipts, contracts and tickets issued by GO Schoolies are issued subject to any and all tariffs, terms and conditions under which any accommodation, transportation or any other services whatsoever are provided by such hotels, airlines, bus companies, railway and ferry companies, or owners or contractors, and by the acceptance of such coupons, exchange orders, receipts, contracts and tickets, the traveller agrees to the foregoing and also agrees that neither GO Schoolies nor any affiliate company or subsidiary shall be liable or responsible for any loss, injury or damage to person, property or otherwise in connection with any accommodation, transportation or other services or resulting, directly or indirectly, from acts of God, dangers inherent to the sea, breakdown in machinery or equipment, acts of government or other authorities, wars whether declared or not, hostilities, civil disturbances, strikes, riots, thefts, epidemics, pandemics, quarantines, medical or customs regulations, delays or cancellations of or changes in itinerary or schedules, or from any causes beyond GO Schoolies control, or for any loss or damage resulting from improper passports, visas or other documents, and that GO Schoolies shall not be liable or responsible for any additional expense or liability sustained or incurred by the traveller as a result of the above stated matters. It is the traveller’s responsibility to email a copy of their current passport 4 months prior to their date of departure. In the event, that an airline ticket needs to be reissued by the airline because of incorrect information supplied by the traveller to GO Schoolies, then the traveller is responsible for any fees or charges for a ticket reissue. Additionally, it is the traveller’s responsibility to ensure that they have the correct visa or ESTA to enter a country. GO Schoolies is not responsible for any fees or charges or the traveller’s inability to participate on the tour due to incorrect entry visas or ESTAs.
  3. GO Schoolies maintains no control over the personnel, equipment or operation of the travel tour, airlines, operators, suppliers or other providers in the itinerary. GO Schoolies assumes no responsibility for, and is not liable for any personal or bodily injury, property damage or other loss, accident, delay or inconvenience resulting from but not limited to a wrongful, negligent or unauthorised act or omission by an employee of an operator, provider or supplier; or any wrongful or negligent act or omission by any party not under the total control, direction and supervision of GO Schoolies.
Risk
  1. The traveller, and where applicable, the parent or guardian of the traveller acknowledges that;
    1. In the country in which your tour is undertaken, standards of accommodation, transport, health care, hygiene, safety, personal security and service provision may not be as high as those standards in Australia.
    2. The additional dangers and risks associated with the tour which the traveller may encounter are difficult and hostile terrain, extremes of weather (including sudden and unexpected changes), political instability, remoteness from usual medical services that you are used to, communication issues (both verbal and technical) and evacuation problems in the event of serious illness or injury.
    3. During the tour, the traveller must be aware of the risks and dangers associated with various activities in which the traveller may, at his/her own discretion, participate. Activities such as swimming, snorkelling, diving, boating, surfing, sailing, water skiing, motor scooters, auto rentals and night activities, and any other sporting event or physical exertion, bear certain risks of personal and bodily injury and other risk of loss. The traveller’s participation in such activities is entirely voluntary, and if the traveller decides to participate in any of these activities, it is done so at the traveller’s own risk. GO Schoolies shall not be liable for any damage, loss or injury that may result from the traveller’s participation in any of these activities. The traveller should make certain that any provider of these services furnishes you with equipment that is well maintained. The traveller must carefully inspect items used.
    4. The traveller has submitted their booking for the tour after giving due consideration of the above and to relevant travel information including, any relevant information or advice given by the Australian government and the government of the country in which the tour is conducted.
    5. The traveller accepts the inherent dangers and the potential risks associated with the proposed tour with the accompanying risk of illness, injury, death and property loss damage.
Traveller's Obligations
  1. The traveller, your parents and/or guardians alone are responsible for your conduct and activities in the course of this tour and you release GO Schoolies from any and all rights, claims, actions, demands, costs and expenses arising out of your conduct and actions. Further, the traveller shall indemnify GO Schoolies for any costs and expenses of whatsoever nature and including legal expenses incurred by it resulting from your conduct or actions or involvement in any activity whilst on the tour including any damage caused by the traveller to another’s property or bodily injury to another person.
    1. The traveller agrees to comply with the law including all legislation, immigration, customs and foreign exchange regulations of the countries to and through which the tour shall pass.
    2. The traveller agrees to comply at all times with GO Schoolies Code of Conduct which form part of these Terms and Conditions.
    3. GO Schoolies reserves the right to cancel a traveller’s tour prior to the commencement of the tour, if in GO Schoolies opinion, the traveller’s behaviour prior to the commencement of the tour places the tour in jeopardy or is a risk to other travellers. The Cancellation clause of these Terms and Conditions will then apply.
    4. The traveller agrees that he/she will abide by the decisions of the GO Schoolies Squad Leader or Leaders engaged by GO Schoolies whilst a tour is in progress.
    5. GO Schoolies reserves the right to withdraw any traveller at any time at its sole discretion and the GO Schoolies Squad Leader may, at any time require any traveller to leave the tour in circumstances where GO Schoolies determines the continued presence of the traveller prejudices the tour’s good order or discipline whether involving a contravention of the law of any country to or through which a tour passes or otherwise. In such circumstances, the traveller will be treated as having cancelled his/her participation in the tour.
    6. The traveller and their parents/guardians agree that they will abide by the GO Schoolies rule that they will at no time consume alcohol or use drugs of any sort whilst participating in the GO Schoolies tour.
    7. GO Schoolies, its agents and or the GO Schoolies Squad Leader having control or supervision of a traveller, reserves the right to return the traveller to Australia if in the opinion of GO Schoolies this is warranted and after discussions with the traveller are non-productive.
    8. In the event that the traveller is removed from the tour and returned to Australia for breach of the above sub-paragraphs, then any additional expenses incurred by GO Schoolies to return the traveller home are at the travellers/parent or guardians expense and the they in turn will reimburse GO Schoolies if that expense has been paid by GO Schoolies.
Liability & Indemnity
    1. The traveller and the parent or legal guardian of the traveller will at all material times indemnify and keep GO Schoolies indemnified, its employees and its GO Schoolies Squad Leaders against all liabilities incurred by the traveller and or his/her parent or legal guardian as a result of any of the following:
      1. the failure to ensure the traveller is in good health at the start of the tour.
      2. the failure to have all necessary documentation available at the start of the tour.
      3. any actions by the traveller whereby GO Schoolies is sued or held liable for that traveller’s actions for restitution, compensation or damages.

    3. Applications will only be accepted if the Terms and Conditions and Code of Conduct are signed and agreed to by both the Applicant and his/her parents or legal guardians.
Non-transferability
  1. Where GO Schoolies, its employees or GO Schoolies Squad Leaders cannot comply with the promises made for the tour for reasons over which they have no control whatsoever then the traveller and his/her parents or guardians waive any and all claims that he/she may now or in the future have against GO Schoolies, its employees and GO Schoolies Squad Leaders, and releases GO Schoolies, its employees and GO Schoolies Squad Leaders from all liability and agrees not to sue GO Schoolies, its employees and GO Schoolies Squad Leaders.
  2. The traveller and/or their parent or legal guardian shall not assign the benefit of this agreement to any other person without the prior written consent of GO Schoolies.
Market (Photos And Other Media)
  1. The traveller grants GO Schoolies and any of its partners or affiliates full permission to record any or all of the traveller’s participation in this tour for photos, motion pictures, videotapes, and other media known and unknown, and to use them, no matter by whom taken, in any manner for publicity, promotions, advertising, trade or commercial purposes, without any reimbursements of any kind due to the traveller, or the need to pay the traveller any fee.
Jurisdiction
    1. This agreement shall be governed and construed in accordance with the laws in force in Victoria for the time being and the parties hereby submit to exclusive jurisdiction of the courts of Victoria, and

The traveller and his/her parents / guardians have made full disclosure to GO Schoolies regarding all matters that are important and relevant to GO Schoolies regarding the tour and are referred to in all these Terms and Conditions and upon which the traveller accepts and knows that GO Schoolies relies upon.
